On Sept. 13, 1995, plaintiff Pamela Vaziri, a 35-year-old, administrative assistant, was in an accident in which her vehicle was struck by a hit and run driver making an illegal u-turn. She hit her head on the driver side window in that accident. The plaintiff reached a settlement with her own insurance company for her injuries. On Nov. 3, 1995, the plaintiff was involved in another accident in which her vehicle was struck from behind at 10 to15 mph by defendant Christine Barbour, a 17-year-old driver of a BMW. The plaintiff claimed she suffered nerve pain (medial bronch posterior ramus) that never went away. The plaintiff brought this action against the defendants based on a negligence theory of recovery.
