On April 18, 1995, plaintiffs Vasiliy and Tatyana Fasolko, an unemployed couple, were stopped for a red light when they claimed their vehicle was rearended by a vehicle operated by the defendant driver. The defendant claimed that the plaintiffs stopped in the intersection on a green light that the plaintiffs' conduct caused this accident. The plaintiffs brought this action against the defendants based on a negligence theory of recovery.
