Facts

Elaine Green was a passenger in a vehicle operated by her live-in boyfriend. As they were exiting a parking lot, they were struck by a vehicle operated by Steven Majoros. Majoros has been reversing out of a diagonal parking space. The rear bumper of his vehicle came into contact with the front passenger side bumper of Green's vehicle. Green sued Majoros for motor vehicle negligence.

Contentions

PLAINTIFF'S CONTENTIONS:
Green argued that Majoros had been negligent for backing out of his parking spot in an unreasonable manner.

DEFENDANT'S CONTENTIONS:
Majoros argued that he looked over his shoulder when backing up and suddenly saw Green's vehicle at the last second. He applied his brakes aggressively but could not stop his vehicle completely before it came into contact with Green's vehicle.

Injuries

Green complained of neck and back pain. She also alleged head injury, face pain, and soft-tissue injuries. She treated with medications she was already taking. She went to a chiropractor for treatment, but was not referred to do so. She underwent a craniotomy in 2010 to remove aneurysms from behind both her eyes.

Result

The jury fount Majoros not negligent.
