Facts
Plaintiffs Guevera and Acosta were business invitees at a Mesa McDonaldÆs on June 5, 1998
when an altercation arose between Acosta, 18, and employee Escarega at the drive-thru window.
A coffee pot was thrown through the car window, striking Acosta in the passenger seat. Acosta
then got out of the car and threw the coffee pot back into McDonaldÆs. Acosta and Escarega
share a mutual ex-boyfriend. He is the father of two of EscaregaÆs children.
Settlement Discussions
Plaintiff Acosta demanded $10,000, while plaintiff Guevera demanded $2,500. The defendants offered $3,000 to plaintiff Acosta and $500 to plaintiff Guevera.
