Facts

On Sept. 28, 1998, the plaintiff was driving a car on Interstate 270 near Vasquez Boulevard. He then pulled
between a Ford F-350 driven by Brickman, a third-party, and a Ford F-250 driven by the defendant. The
defendant rear-ended the plaintiffÆs vehicle, and the plaintiff rear-ended the truck in front of him.
Brickman testified that the defendant was "riding his tail" for several miles before the
plaintiff pulled between BrickmanÆs vehicle and the defendantÆs vehicle. Brickman testified that
he was glad the vehicle pulled in between because it stopped the defendant from tailgating his
vehicle.

Settlement Discussions

There was a $25,000 final demand before trial and there was a $3,100 offer of settlement according to the defendantÆs attorney.
