Facts

In 1998, KN Energy had the rights to go through and install a gas pipeline on Grant RumseyÆs
ranch. The company hired Hiner Construction to install the pipeline, and KN supervised the
project. Hiner Construction tore down a fence on the property and installed a temporary fence to
keep RumseyÆs cattle out of the construction area. On March 3, 1998, the construction company
replaced the temporary fence with the original fence. Three weeks later, the plaintiff was injured
from wire in his pasture.

Settlement Discussions

There was a final demand before trial at a settlement conference of $150,000 preceded by a $125,000 demand according to the plaintiffÆs attorney. The defense attorney reported a $150,000 demand at the settlement conference followed by a $300,000 demand shortly after the conference. The final offer about one week prior to trial was $125,000 preceded by an $80,000 offer according to the defendantsÆ attorney. There was a $75,000 offer one month before trial according to the plaintiffÆs attorney.

Injuries

The plaintiff suffered nerve injury in the left leg and resulting weakness in that leg which is a permanent condition. Rumsey, a self-employed farmer and rancher, alleged that he had to hire additional help because he could only walk for short periods of time.
