Facts
On Sept. 11, 1998, a non-party Joyce Chang lost control of her vehicle after coming into contact with standing water in the southbound lane of Highway 89A. After a drainage ditch became clogged with cinders, water was backed onto the highway. Williams, a 43-year-old traveling northbound in his Chevrolet truck, was struck head-on by Chang.
Settlement Discussions
There was a final demand by the plaintiff of $750,000. The defendant made no offers. Relative to subrogation, there was federal government intervention, with $146,000, awarded because William's has Native American origin.
