Facts
On Dec. 4, 1998, Shing-Jiuan Liau was riding a bicycle at the intersection of 30th and Walnut when Boes' vehicle struck Liau. Boes ws turning right on 30th Street. One eyewitness said that the plaintiff did not stop before entring the crosswalk. Another eyewitness said that the plaintiff and defendant had both stopped.
Settlement Discussions
There was a $120,000 final demand before trial (policy limits of $100,000 plus interest of $20,000). There was a $25,000 statutory offer of settlemetn preceded by a $50,000 offer. The offer had expired but the defendant indicated a willingness to settle up to the start of the trial.
Injuries
Post-traumatic stress disorder, minor traumatic brain injury, soft tissue injuries to the neck and physcial impairment. Medical and rehabilitation expenses of $100,000 plus an additional $6,000 unpaid medical expenses and approximately $25,000 in future medical expense. There were alleged economic losses of $1.2 to $1.6 million. The plaintiff alleged that the injuries caused a delay in her education. She was studying for her masters in dance movement therapy at Naropa Institute.
