Facts

On Aug. 21, 1995, the plaintiff, Pommerenck, left his place of employment at approximately 3:45
p.m. and was riding a bicycle enroute to his home at the time the accident occurred. Moments
before the accident, he was directing his bicycle over an overpass and traveling westbound on
Avenue L in the City of Lancaster. While doing so, on the right, (north side of Avenue L), a third
party operating a 1976 Plymouth Valiant automobile, driving in a dedicated lane and transitioning
onto westbound L from southbound Sierra Highway, jumped the curb to his right (north) and
struck a cement light pole which thereafter fell and struck the bicycle riding plaintiff.

Injuries

The plaintiff suffered a fractured right femur, rib fractures, comminuted fracture of left radius, compound fracture of the right tibia/fibula and right fifth metacarpal, laceration to forehead, left arm, side and knee, sprained left ankle, nerve damage to left elbow, hypothyroidism, anxiety, lethargy, multiple contusions and bruises, emotional distress, pain and suffering.

Result

This case resolved by way of motion for summary judgment (not appealed) taken under submission on March 22, 2001 with the courtÆs order granting same on April 4, 2001.
