Facts

On Feb. 23, 1997, the plaintiff was a passenger in a vehicle driven by her mother, Nancy DeAguero. There was a dispute as to whether the plaintiff was wearing a seatbelt.

Settlement Discussions

There was a $45,000 final demand at a settlement conference. There was a prior demand of $100,000. There was a final $20,000 statutory offer before trial.

Injuries

The plaintiff alleged thoracic outlet syndrome, concussion, post-traumatic headaches, cervical sprain and strain depression.
