Facts
On Aug. 3, 1996, the plaintiff Soderbloom was driving east on I-70 near the 6th Avenue exit. The defendant, Wright, was driving in front of the plaintiffÆs vehicle. The defendant was driving a convertible with the top down when it started to rain. A three-car collision, which also involved a motorcycle, then occurred, and the two riders on the motorcycle were killed.
Settlement Discussions
There was a final demand of a $50,000 statutory offer of settlement and there was a final $6,000 statutory offer of settlement.
Injuries
Lower back sacral torsion resulting in permanent impairment. The PIP carrier paid past medical expenses of approximately $7,500. Non-economic losses.
Other Information
The plaintiff designated three non-parties: Wen Lin, Northern Colorado Traffic Control and Asphalt Paving. The court determined as a matter of law that Northern Colorado Traffic Control and Asphalt Paving were not negligent. The jury found that the plaintiff was not injured, the defendant was not negligent and the defendant did not cause any injuries or damages claimed by the plaintiff. The plaintiff filed a post-trial motion for judgment notwithstanding the verdict and a new trial. An appeal is pending.
