Lanie Lim and John Lewert filed a class action against Vendini Inc., in connection with a notice issued by Vendini in May 2013 that on or about April 25, 2013, it had detected potential unauthorized access by a third party to its databases and to customers' personal identification information.
Vendini handled ticket sales for event and entertainment venues across the country. In this capacity, Vendino collected and stored customer information, including names, addresses, telephone numbers, e-mail addresses, and credit card numbers.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that defendant's data security violated California laws, and constituted breach of contract, breach of implied contract, negligence, unjust enrichment, and invasion of privacy.
DEFENDANT'S CONTENTIONS:
Defendant denied any wrongdoing and liability whatsoever.
Result
The parties reached an agreement, where defendants agreed to create a $3 million class settlement fund to which class members may submit claims.
