Facts

Miriam De La Cruz and Alfonso Franco filed suit against Ana Chirino and Valentin Darie in relation to a motor vehicle accident.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that on Nov. 3, 2011, De La Cruz was driving with her son Franco in the car as well. A rear-end collision involving Chirino's car, and Darie's car occurred. Plaintiffs alleged the defendants drove their cars negligently. In addition, she claimed Chirino hit her car and caused her car to smash into the one in front of it. They claimed defendant drove too fast and too close to other cars.

DEFENDANT'S CONTENTIONS:
Chirino alleged Darie started the accidents and was its only cause, however, Darie argued that Chirino crashed into the back of De La Cruz's car initially.

Damages

De La Cruz sought $4,020 in past medical costs, and Franco sought $3,390.

Injuries

Plaintiffs suffered back and neck injuries, cephalagia and headaches. They required chiropractic care and physical therapy.

Result

Under a settlement, De La Cruz received $5,000, of which Chirino's insurer paid $4,500, and Franco received $4,500, of which Chirino's insurer paid $4,000. Darie's insurer paid each plaintiff $500.
