Facts

Anthony Broussard filed suit against Manuel Chavez, the Housing Authority of San Bernardino County and San Bernardino County in relation to a motor vehicle accident.

The county was later dismissed.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Nov. 14, 2011, he was driving when a utility truck driven by Manuel Chavez crashed into him. Chavez was working for the Hosing Authority at the time. Plaintiff argued that he was stopped a red light at an intersection when defendant's truck rear-ended his vehicle. He alleged that Chavez was driving negligently and that his employer should be held liable as well.

DEFENDANT'S CONTENTIONS:
Defendants argued that both drivers were reversing out of separate driveways on each side of the street when they collided. Defendants asserted that plaintiff was also responsible for the accident as a result.

Settlement Discussions

Plaintiff demanded $49,999 under CCP Section 998 and the defense offered to waive costs.

Injuries

Broussard suffered aggravation of a pre-exiting condition, back and neck injury, and leg injury and sprains. He required implanted hardware, physical therapy and installation of pins, rods and screws.

Result

The jury awarded Broussard $77,411, determining that Chavez caused the injuries entirely.
