Facts

Maria Jimenez sued the City and County of San Francisco in connection with an incident that occurred on March 5, 2012.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was walking along Mission St. with her son, Amulio Jimenez, when she tripped and fell on a broken crosswalk pavement. Plaintiff was injured as a result. Her son was shocked to witness plaintiff's fall. Plaintiff asserted causes of action for negligence, premises liability, and negligent infliction of emotional distress on a bystander.

DEFENDANT'S CONTENTIONS:
The city denied any wrongdoing, and asserted various affirmative defenses.

Damages

Plaintiff sought damages for wage loss, hospital and medical expenses, general damages, loss of earning capacity, and emotional distress. Her son sought damages for emotional distress.

Injuries

Plaintiff was injured as a result of the trip and fall incident. Plaintiff's son suffered emotional distress from witnessing his mother's injury.

Result

The parties reached a $90,000 settlement.
