Facts

Vahik Jamshidian filed a lawsuit against Michael Shiffman and Asher Gottesman in relation to a motor vehicle accident. Shiffman was later dismissed.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on March 26, 2012, he was driving his vehicle when Gottesman crashed into the rear of plaintiff's car. He alleged that Gottesman drove negligently and that Shiffman should be liable as the registered owner of the car.

DEFENDANT'S CONTENTIONS:
Defendant Gottesman argued that plaintiff's injuries were exaggerated because he only complained about an injured elbow at the time of the crash and told paramedics that he did not have a neck injury. In addition, defendant argued that an arm X-ray did not show that it was fractured, and that plaintiff had lapses in the time period within which he received care. Last, he contended that a later accident could have brought about plaintiff's injuries.

Damages

Plaintiff requested $30,878.38 in past medical expenses, $168,000 in further medical expenses, $600 for lost earnings, between $100,00 and $125,000 for past pain and suffering, and $200,000 for future pain and suffering.

Injuries

Plaintiff suffered cervical disc injury, exacerbated a degenerative disc condition, and neck injury. He received chiropractic treatment and epidural injections.

Result

The jury awarded plaintiff $173,190.
