Facts

Raul Villa-Estrada filed an action in relation to his employment against Priority Building Services LLC.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that he began working as a handyman for Priority on May 20, 2008 and that it did not compensate him properly or give him rest breaks, in contravention of the California Business and Professions Code. He argued that after he took a vacation, he was fired, he was not paid overtime, and he did not receive itemized wage statements.

DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations and argued that plaintiff was given proper rest breaks and the compensation to which he was entitled.

Damages

Plaintiff asked for $26,004 in unpaid overtime, $9,264 in unpaid rest time, $40,212 due to the allegedly willful failure to pay, and $4,000 in penalties based on the wage statement violation.

Result

According to a settlement agreement, Priority paid plaintiff $17,500.
