Nen Thio, Tju Tjin Liem, and Denny Wijaya filed a class action complaint against Genji LLC, Genji Retail Support Inc., and Genji Inc. Plaintiffs worked for Genji, a retail provider of sushi and Japanese cuisine.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs asserted various employment related causes of action against defendants, including, failure to pay minimum wage and overtime compensation, failure to provide adequate rest periods, failure to provide adequate meal periods, and wrongful termination. Plaintiffs also alleged that defendants misclassified some of the class members as exempt managers, rather than non-exempt employees, resulting in failure to pay overtime wages regardless of the number of hours worked.

DEFENDANTS' CONTENTIONS:
Defendants denied the allegations made by plaintiffs.

Result

The court granted preliminary approval of the class action settlement between the parties. Under the terms of the settlement, defendants agreed to pay a total amount of $1,250,000.
