Cali Burchett filed a lawsuit against George Staykow in relation to an accident at Staykow's home.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff, who was 8-years-old at the time of the accident, alleged that on June 1, 2008, she was jumping on a trampoline at defendant's home with a friend. They played a game where one girl would jump in order to boost the other into the air. In doing so, plaintiff suffered an injury to her leg. On her behalf, her family alleged that defendant should have supervised them, because although he observed them, he did not tell them to stop the game. The children's mothers claimed that they were outside of the home, but defendant did not let them inside.
DEFENDANT'S CONTENTIONS:
Defendant argued that he was unaware of the children's presence on the trampoline, and alleged that their mothers should be liable for improperly supervising their children.
Injuries
Cali claimed to have suffered epiphysiolysis, distal, femur fracture, hardware implanted a shortened leg, installed plate, and osteotomy.
Result
The parties reached a settlement under which plaintiff received $750,000.
