Plaintiff Erlinda Ballesteros and defendant Ellea Low were involved in an automobile accident. Two days prior to the car accident, the plaintiff slipped and fell on her garage floor, injuring her back. The plaintiff brought suit for negligent operation. The plaintiff claimed that the defendant made a u-turn directly in front of plaintiff's vehicle.

The defendant denied the allegation of negligence and disputed the nature and severity of plaintiff's claimed injuries.
