Facts

A class action was filed against Hyundai Motor America Inc. for class members included current and former owners or lessees of a 2003 manual-transmission Tiburon GT produced on or before April 1, 2003, who paid for a replacement to the car's flywheel assembly, clutch disc assembly, clutch cover assembly, or clutch release bearing within the car's warranty period.

The court certified a national litigation class on November 6, 2008.

Result

The parties reached a settlement, under which eligible class members receive cash reimbursements for money spent on certain flywheel/clutch parts repairs to their 2003 Hyundai Tiburons. The reimbursement amount is based on the amount spent and the vehicle mileage at the time of the repairs: for vehicles with up to 50,000 miles at the time of repair, the reimbursement is 100% of the amount paid for the repair; for vehicles with between 50,001 and 75,000 miles at the time of repair, the reimbursement is 75% of the amount paid for the repair; and, for vehicles with between 75,001 and 100,000 miles at the time of repair, the reimbursement is 50% of the amount paid for the repair. Class members are also eligible to receive up to $150 in rental expenses for each flywheel/clutch repair.
