In May 2009, plaintiffs sued defendant Wm. Wrigley Jr. Co., which produced Eclipse chewing gum and mints, alleging that defendant engaged in misleading advertising in relation certain gum and mint products.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs contended that defendant falsely stated that its products had natural germ killing properties
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations.
Result
The parties reached a settlement, under which defendant agreed to create a fund of $6 million to reimburse customers up to $10 for purchases, as well as an extra $1 million if required to satisfy the claims. In addition, defendant agreed to alter its marketing in relation to the products.
