Rushdi Zalatimo filed an arbitration claim against J.P. Turner & Company LLC in relation to expungement of his records.

Contentions

CLAIMANT'S CONTENTIONS: Zalatimo requested an expungement of three occurrences from his Central Registration Depository records and similarly contended respondent was liable for compensatory damages of $1.

RESPONDENT'S CONTENTIONS: Respondent contended it was not liable for compensatory damages.

Result

The arbitrator denied the claim for compensatory damages. The arbitrator decided to expunge two of the occurrences because Zalatimo was not involved with one occurrence and the other was false. However, the arbitrator denied expungement of the third occurrence because Zalatimo failed to provide adequate proof to satisfy the requirements of FINRA Rule 2080.
