Facts

Plaintiff Mykyn Woods filed a disability discrimination lawsuit against her former employer, defendant Greystar Management Services, LP, after she became temporarily disabled due to a car accident.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that after she became temporarily disabled due to a car accident, defendant erroneously believed that under defendant's sick leave policy, plaintiff was only entitled to 6 unpaid weeks off work because she had not yet worked there for more than a year.

Plaintiff contended that she was not "sick," but that she was disabled; and that defendant Greystar failed to follow not only the law, but its own corporate policy that says it will reasonably accommodate employees with known disabilities unless doing so would cause the company an undue hardship.

Plaintiff asserted causes of action for wrongful termination, disability discrimination, failure to reasonably accommodate, failure to engage in an interactive process and failure to take reasonable steps to prevent discrimination.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Other Information

The jury was unanimous (12-0) on all causes of action, except one. On the cause of action the jury was not unanimous on (Disability Discrimination), the split was (11-1). The jury was also unanimous as to the punitive damages award. Plaintiff argued that the defense witnesses lied and back-dated documents to try to justify the termination after the fact.
