Contentions
CLAIMANT'S CONTENTIONS: Rener alleged that the customer dispute information, Occurrence Numbers 143726 and 234926, should be expunged from his CRD records. Further, Rener contended that the termination disclosure, Occurrence Number 221725, should be expunged from his CRD records because it was defamatory.
RESPONDENTS' CONTENTIONS: UBS denied wrongdoing but did not oppose Rener's request for expungement. Oppenheimer refused to consent to Rener's request for expungement.
Result
The arbitrator recommended expungement of all references to Occurrence Number 221725 from Rener's registration records and found that the information was defamatory. The arbitrator denied Rener's request for expungement of Occurrence Numbers 143726 and 234926 from his registration records.
