ADKO Investors LLC and several other claimants filed a complaint against CapWest Securities Inc. alleging several causes of actions including breach of contract, breach of fiduciary duty, and violation of several statutes related to claimants' investments in Provident Royalties Inc., Medical Capital Corp. and DBSI Inc.

Damages

Claimants sought damages, rescission, compensatory damages plus interest, punitive damages, as well as attorney costs and fees.

Result

The Panel found respondent liable for $7,925,763 in compensatory damages; $1,188,863 in attorney fees; $5,840 in costs; and interest.
